Terms of Service
The agreement between you and Veratec s.r.o. for using HugoFamily. We try to write in plain language — where a term has a precise legal meaning, that's what we mean.
Working version (draft). This document is under legal review and may still change before launch; we'll publish the binding wording once the review is complete. Questions: privacy@hugofamily.app.
By creating an account, joining a family, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. What HugoFamily is
HugoFamily is a mobile-first, multilingual app — one calm place for the logistics of family life: shopping, tasks, loyalty cards, family notes, meal planning, pocket money, and more modules over time. Features are grouped into modules (for example HugoShopping, HugoTasks, HugoCards, HugoNotes, and HugoMeals); the optional Hugo / HugoAI assistant can help with automation. Some features are free; others require a paid subscription. We host and operate the Service for you.
We may add, change, or remove features. We try not to break things that matter to families, and we'll tell you about significant changes.
2. Who can use HugoFamily
- You must be old enough to enter into a contract in your country. If you're a minor, an adult (a parent or guardian) must agree to these Terms and manage the family account.
- Families include children. A parent (admin) role manages the family, billing, and access; a child role has a limited, age-appropriate experience. Only a parent/admin can buy, change, or cancel a subscription. By adding a child, you confirm you are their parent or legal guardian (or have the necessary permission). See the Privacy Policy.
- You're responsible for everything under your account and within your family, and for keeping your sign-in method secure.
3. Accounts and sign-in
You sign in without a traditional password using one or more of:
- a magic link sent to your email,
- a social login (Google, Apple, Microsoft),
- a passkey on your device.
You agree to give accurate information (a working email address) and to keep your devices and email secure. If you suspect unauthorised access, write to support@hugofamily.app.
4. Acceptable use
Use HugoFamily to organize your own family. You must not:
- break the law, or use the Service to harm, harass, or abuse anyone;
- upload content that is illegal or that you don't have the right to share;
- access other families' data, or probe or breach our security;
- overload, disrupt, or reverse-engineer the Service (except any rights you have by law);
- resell or commercially exploit the Service without our written permission;
- use automated access (the API, integrations, tokens) in a way that abuses the Service or circumvents your plan's limits.
If you break these rules, we may limit, suspend, or terminate access — generally with notice, unless we must act immediately to protect people or the Service.
5. Your content and data
- Your family's content is yours. Lists, tasks, notes, prices, member names, and similar data (“Your Content”) belong to you — we don't claim ownership of it.
- You grant us only the limited permission needed to operate the Service: to store, process, back up, sync, and display Your Content to your family members and to provide the features you use. Nothing more.
- You're responsible for Your Content being lawful and for having the right to store it (including any information about other people you add).
- You can export your family's data and delete your family at any time in the app's settings.
6. Plans, free tier, and trials
HugoFamily uses a freemium model with per-household subscriptions:
- Free: a genuinely useful free tier (for example, a daily shopping list for a small family) with limits on modules and the number of members (“seats”). The free tier is free forever while your family keeps using it. A free family that is inactive for 3 months is reminded by email and then permanently deleted (see §8 and the Privacy Policy).
- Paid plans (e.g. Premium and Top / Family Plus): more modules, more seats, and additional features. Prices, seat limits, and the contents of each plan are shown at checkout and on the Pricing page — they form part of these Terms.
- Trials: if offered, convert to a paid subscription unless you cancel before they end. You'll see the length and terms when you start one.
We may change plans, limits, and prices for the future. A change to an active paid subscription requires reasonable prior notice; if you don't agree, you can cancel.
Founding Families Program: families who join by 1 January 2027 keep today's founding prices for the first subscription year. From 1 January 2027 standard prices apply (roughly 25 % higher). Details on the Pricing page.
7. Billing and payments (Paddle as merchant of record)
Payments for paid subscriptions are handled by Paddle, acting as the merchant of record. For the purchase, Paddle is the seller to you: it processes the payment, issues the invoice/receipt, and handles taxes (such as EU VAT). Your purchase is also subject to Paddle's terms at checkout.
By subscribing, you agree that:
- subscriptions renew automatically (monthly or annually) at the then-current price, until you cancel;
- annual plans may be offered at a discount (for example, two months free compared to monthly);
- you authorise Paddle to charge your chosen payment method (card, Apple Pay, Google Pay, etc.) for each renewal;
- you keep your payment details up to date; you manage payments, invoices, and your subscription through Paddle's customer portal, linked from the app.
Refunds are described in our Refund Policy, including your EU right of withdrawal.
8. Cancellation and what happens to your data
- You can cancel a paid subscription at any time (in the app or via the Paddle customer portal). Cancellation stops future renewals; you keep paid access until the end of the period you've already paid for, after which the family returns to the free tier.
- We don't delete your family's data when a subscription ends — the family is downgraded to free-tier entitlements; features above the free tier become unavailable (or read-only) until you upgrade again.
- If a payment fails, there's a short grace period with a reminder; if it isn't resolved, you're downgraded to free — again, without deleting your data.
- Ending a subscription never deletes your data. A family that stays on the free tier and becomes inactive for 3 months is reminded by email first and then permanently deleted (see §6 and the Privacy Policy).
- Permanent deletion of the family and its data: the Delete option in settings. Once confirmed, the family is deactivated immediately and the data is permanently purged after a short retention window — see the Privacy Policy.
9. The Hugo assistant (AI) and automation
The Hugo / HugoAI assistant is optional — the app is fully usable without it.
- AI suggestions may be inaccurate. Don't rely on them for important, safety-critical, or financial decisions without checking. You're responsible for what you do with AI output.
- If AI features rely on third-party providers, your relevant inputs may be processed by them to generate a response — see the Privacy Policy.
10. Integrations and third-party services
HugoFamily can connect to third-party services (e.g. Home Assistant, email) and uses providers to run (payments, email, hosting, error monitoring). Your use of a third party is subject to its own terms and privacy practices. You're responsible for the credentials and tokens you create for integrations and for keeping them secret.
11. Suspension and termination
- You can stop using the Service or delete your family at any time.
- We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect users and the Service. Where reasonable, we'll give notice and a chance to fix the issue; for serious cases (illegal use, a security threat) we may act immediately.
- On termination, the provisions that should survive continue to apply (content ownership, disclaimers, liability limits, governing law).
12. Service availability
We work to keep the Service reliable, but we provide it “as is” and “as available.” We don't promise it will be uninterrupted or error-free; maintenance or updates may take place. Your mandatory consumer rights are not affected.
13. Intellectual property
The HugoFamily name, logos, brand (HugoFamily, HugoAI, HugoShopping, HugoTasks, HugoCards, HugoNotes, HugoMeals, HugoPocket, and the “Hugo” persona), website, and the design and software of the Service are owned by us or our licensors and protected by law. Except for the rights granted by these Terms, we don't grant you any rights to our intellectual property. Your Content remains yours (§5).
14. Disclaimers and limitation of liability
- To the extent permitted by law, the Service is provided without warranties of any kind, express or implied (including fitness for a particular purpose or non-infringement).
- To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses, lost data not caused by us, or lost profits. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) EUR 50.
- Nothing in these Terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or your mandatory consumer rights under EU and local law.
15. Changes to these Terms
We may update these Terms. For a material change we'll give reasonable prior notice (by email or in the app). If you keep using the Service after the change takes effect, you accept the updated Terms. If you don't agree, you'll stop using the Service and, where applicable, cancel your subscription.
16. Governing law and disputes
Podmínky se řídí právem České republiky, bez újmy na povinných právech spotřebitele ve vaší zemi bydliště. Spory nejdřív řešíme neformálně — napište nám. Jste-li spotřebitelem v EU, můžete využít platformu ODR Evropské komise: ec.europa.eu/consumers/odr.
